■ 2007.06.26 ビジネスビザ取得に必要な英語力

7月1日から、ビジネスビザ申請者に対して「IELTS平均4.5以上の英語力」が求められます。
しかし、これには「例外規定」があり、次のいずれかに該当する申請者は英語の要件を満たす必要はありません。
以下、添付の移民省大臣発表資料からの抜粋（+和訳）です。

Applicants will not be required to meet the English language requirement if;

(1).their first language is English and they are a passport holder from Canada,
New Zealand, the Republic of Ireland, the United Kingdom or the United States of America; or
（カナダ、NZ、アイルランド、イギリス、アメリカのパスポートを持ち、母国語が英語である）

(2).their nominated occupation is within the highly skilled major groups 1-3
of the Australian Standard Classification of Occupations (ASCO), comprising
managers, administrators, professionals and associate professionals; or
（申請する職種が職業分類表の1000番～3000番台である）

(3).they have completed at least five years of continuous full time secondary
and/or tertiary education at an institution where at least 80 percent of instruction was conducted in English or
（授業の80％以上が英語で行われる中学、高校、専門、短大、大学に、5年以上通っている）

(4).they are to be paid at least a salary specified in a legislative
instrument (initially a gross base salary of $75 000 excluding all allowances and deductions).
（基本給がグロスで年収75,000ドル以上ある）

現在、駐在員のほとんどの方は、(2)に該当いたしますので、これまで通り、IELTS
スコアなしでビジネスビザ取得が可能です。（添付の「Gazetted occupation for s457」にある 1000番～3000番台の職種に該当します。）また、(4)に該当することでIELTS不要になるケースもあります。したがって、今回の英語力の要件については、ほとんど心配なさらずに、これまで通りに人事異動計画が可能です。

英語が求められる例としては、美容師やコックなど「手に職」系の職種で申請している場合や、
地方の雇用主にスポンサーされる場合で、5000～7000番台の職種で申請している場合が考えられます。これらに該当する方は、IELTS平均4.5以上のスコアが求められます。

技術独立系のビザについて、２００７年９月１日申請受理分から新しい移民法が適用になります。今回の改定では、技術独立ビザのサブクラスやポイントテストの内容が大幅に変わりますので、変更点をしっかり把握し、永住ビザ取得の可能性や方法を再確認する必要があります。

新しいポイントテストでは、英語力やオーストラリアでの職歴・学歴が重視されています。
これに伴い、18ヶ月有効の一時滞在ビザSkilled - Graduate (s485)が新設されました。留学後、惜しくも永住権の要件を満たせない場合は、s485を取得し、ビザの有効期間中に更なる職歴や学歴、英語力をつけるチャンスが与えられています。s485保持者は永住ビザの要件を満たすことができた時点でいつでも永住ビザを申請することができます。

３年以上の留学で、Honours [second class （division 1)]付でBachelor を修了している
２年以上の留学の要件を満たしている	5点

● 需要職業：　

申請する職種が需要職業リスト（MODL）に記載があり、申請職種あるは近い職種で申請日から遡って過去48ヶ月のうち12ヶ月以上の職歴があり、かつ、申請職種あるいは近い職種でフルタイムのジョブオファーがある

英語力は現行法の最低基準IELTS全5.0以上が、同全6.0以上に引き上げられますがコックや美容師などいわゆる「手に職」系の職種の場合には全5.0以上に据え置きになるほか、Skilled - Regional Sponsored (s475 or s487)を申請する場合、Overall5.5以上で認められます。

また、需要職業点については、申請職種あるいは近い職種で12ヶ月以上の職歴が必要になり、需要職業点の取得を見込んで現在留学している方には厳しい内容となりましたが、s485を保持者として当該職種で12ヶ月以上の職歴を積めば、需要職業点15点のほか、オーストラリア職歴点10点を加算できます。

留学後、ただちに永住権申請の要件を満たせる場合は、従来通り、コース修了後６ヶ月以内なら職歴免除で永住権を申請することができます。一方、職歴を積んで申請する場合、申請する職種に関係なく、申請日から遡って過去24ヶ月のうち12ヶ月以上、申請職種か近い職種での職歴が求められます。

なお、パスマーク（現行法120点）見直しについても検討されています。

今回の移民法改定においては、Transactional arrangement はありません。このため、永住権申請が９月１日以降になる方すべてに影響しますので、おそらく多くの方にとってs485の申請・取得が必要になることが予想されます。Skilled - Graduate (s485)の申請要件は次の通りです。
● ２年以上の留学のための学生ビザを保持している、または、申請前の６ヶ月以内に保持していた。
● ２年以上の留学要件を満たし、コース修了後、６ヶ月以内である。
● スキル審査機関に申請を済ませている。
● ポイントテストの英語要件を満たしている。

s485保持者は将来、次の永住ビザを申請することができます。
● Provisional Skilled - Regional Sponsored (s487)
● Permanent Skilled - Independent(885)
● Permanent Skilled - Sponsored (s886)
また、雇用主指名ビザ(s856)やRSMS(s857)も申請可能。Graduate Skilled Temporary Visa (s497)保持者も９月１日以降、これらのビザを申請できます。

「２年間の留学コースの要件」や「10万豪ドル分の州債投資」については引き続き検討されており、決定され次第、発表される予定です。「配偶者点」「特定職業点」「地方点」「ボーナス点（日本語など）」については、今回の発表ではとくに言及されておりません。

今学期で留学コースを修了できる場合、８月３１日までの申請を目指し、コース修了前から周到に準備を進めることをお勧めします。来学期以降のコース修了になる場合には、とくに「手に職」系の職種の場合、Skilled - Sponsored (s176) の可能性も検討されてみるといいでしょう。
